Terms and conditions of service

The user navigating in this area accesses Sudrise (www.sudrise.com). Navigation and the transmission of a purchase order on the site imply acceptance of the Terms and the Data Protection Policies adopted by the site as indicated therein.

The present General Conditions of Sale apply to the sale of products exclusively concerning purchases made on the Sudrise site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree No. 206/15 amended by Legislative Decree No. 21/14 and Legislative Decree 70/03) by:

1.Subject

The user is required, before accessing the products provided by the site, to read these General Terms and Conditions of Sale that govern the offer, submission, and acceptance of purchase orders on Sudrise and do not govern, instead, the provision of services or the sale of products by parties other than the seller that are present on the same site through links, banners, or other hypertext connections.

Before submitting orders and purchasing products and services from different parties, we suggest verifying their terms of sale.


2. Conclusion of the Contract

To conclude the purchase contract, it will be necessary to fill out the electronic purchase form and submit it following the relevant instructions.

It contains: the reference to the General Terms and Conditions of Sale, images of each product and their respective prices, the payment methods that can be used, the delivery methods for the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, the methods and times for returning the purchased products.

Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data. The contract is concluded when the seller receives the purchase form, subject to verification of the correctness of the data contained therein.

The buyer will be obliged to pay the price from the moment the online order submission procedure is completed. This will occur by clicking the button: Buy and complete the order at the end of the guided procedure.


3.Registered Users

By completing the registration procedures, the user agrees to follow the instructions on the site and to provide their personal data accurately and truthfully. The confirmation releases Sudrise from any responsibility regarding the data provided by the user.

The user agrees to promptly inform Sudrise of any changes to their data communicated at any time.

If the user communicates inaccurate or incomplete data or in the event of a dispute by the interested parties regarding the payments made, Sudrise will have the right not to activate or to suspend the service until the related deficiencies are remedied.

Upon the first request for activation of a profile by the user, Sudrise will assign the user a username and a password. The user acknowledges that these identifiers constitute the validation system for the user's access to the Services and the only system suitable for identifying the user, so that the actions performed through such access will be attributed to him and will have binding effect against him.

The user agrees to maintain the confidentiality of their access data and to safeguard it with due care and diligence, and not to disclose it, even temporarily, to third parties.


4.Product Availability

The availability of products refers to the actual availability at the moment the buyer places the order. This availability should be considered purely indicative because, due to the simultaneous presence of multiple users on the site, products may be sold to other customers before the order confirmation.

Even after the sending of the order confirmation email, there may be cases of partial or total unavailability of the goods.In this event, the order will be automatically corrected by removing the unavailable product, and the buyer will be immediately informed via email or phone.

If the buyer requests the cancellation of the order, terminating the contract, Sudrise will refund the amount paid within 14 days from the moment Sudrise became aware of the buyer's decision to terminate the contract.

6. Payment Methods and Prices

The price of the products will be as indicated from time to time on the site, unless there is a clear error.

In case of error, Sudrise will notify the buyer as soon as possible, allowing for the confirmation of the order at the correct amount or cancellation.

In any case, Sudrise will not be obliged to provide the sold items at the incorrectly indicated lower price.

The prices on the site include VAT but do not include shipping costs. Prices may change at any time. Changes do not affect orders for which confirmation has already been sent.

Once products are selected, they will be added to the cart. It will be sufficient to follow the instructions for purchase, entering or verifying the required information at each step of the process. Order details can be modified before payment.

Payment can be made via: Paypal, Bank Transfer, Check, Cash on Delivery, Cash, Money Order, Credit Card.

The accepted credit cards will be as follows: Visa, Mastercard, American Express


7.Sales Conditions

The sale of alcoholic products available on the electronic platform is reserved exclusively for customers who have reached the legal age as per current regulations. Therefore, the customer guarantees with their registration and acceptance of the general sales conditions that the purchase is made by a person over 18 years of age.
 

8.Delivery

Sudrise ships worldwide.

Delivery will take place as per the purchase form by the date indicated therein; if no delivery date is specified, it will occur within the estimated timeframe at the time of selecting the delivery method and, in any case, within a maximum period of 10 days from the confirmation date.

If delivery is not possible, the order will be sent to the depot. In this case, a notice will specify the location of the order and the procedures to arrange a new delivery.

If you are unable to be present at the delivery location at the agreed time, we ask you to contact us again to arrange a new delivery date.

If delivery cannot take place for reasons not attributable to us after 15 days from the date the order is available for delivery, we will assume that you intend to terminate the contract.

As a result of the termination, amounts will be refunded, including delivery costs, excluding any additional costs arising from the choice of a delivery method different from the standard method offered, without undue delay and, in any case, within 14 days from the date of contract termination. The transport resulting from the termination of the contract may incur additional costs that will be borne by the buyer.


9.Risk Transfer

The risks related to the products will be transferred to the buyer from the moment of delivery. Ownership of the products is considered acquired as soon as full payment of all amounts due in relation to them, including shipping costs, is received, or at the time of delivery, if this occurs at a later date.


10.Warranty and Commercial Compliance

The seller is responsible for any defects in the products offered on the site, including non-compliance of the items with the ordered products, in accordance with Italian law.

If the buyer has entered into the contract as a consumer, meaning any natural person acting on the site for purposes unrelated to any entrepreneurial or professional activity they may carry out, this warranty is valid provided that the defect manifests itself within 24 months from the date of delivery of the products; that the buyer formally submits a complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized by them; and that the online return form is correctly filled out.

In case of non-compliance, the buyer who has entered into the contract as a consumer shall have the right to obtain the restoration of the conformity of the products at no cost, through replacement, or to obtain an appropriate reduction in price or the termination of the contract regarding the disputed goods and the consequent refund of the price.


11. Right of Withdrawal

In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.In the case of multiple purchases made by the buyer with a single order and delivered separately, the 14-day period starts from the date of receipt of the last product.

The buyer who intends to exercise the right of withdrawal must communicate this to Sudrise through an explicit declaration, which can be sent by registered mail or by sending an email to info@sudrise.com

The buyer must also exercise the right of withdrawal by sending any explicit communication containing the decision to withdraw from the contract.

The right of withdrawal will be excluded pursuant to Article 59 of the Consumer Code for products that risk deteriorating or for hygienic reasons cannot be returned after opening.

The consumer is solely responsible for the decrease in value of the goods resulting from handling the goods in a manner other than that necessary to establish the nature, characteristics, and functioning of the goods.

The goods must be returned intact, in the original packaging, complete in all its parts and accompanied by the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum period of 14 days, including any shipping costs.

As provided for by Article of February 21, 2014, no. 21, which implements Directive 2011/83/EU on consumer rights, amending the Consumer Code (Legislative Decree September 6, 2005, no. 206).

The site will process the refund using the same payment method chosen by the buyer at the time of purchase. In the case of payment made by bank transfer, and if the buyer wishes to exercise their right of withdrawal, they must provide the necessary bank details including IBAN, SWIFT, and BIC for the refund to be processed.


12. Data Processing

The buyer's data is processed in accordance with the provisions of the legislation on personal data protection, as specified in the appropriate section containing the information pursuant to Article 13 of Legislative Decree No. 196 of June 30, 2003 (Privacy Policy).
 
This platform is governed by Regulation EU 2016/679 known as GDPR (General Data Protection Regulation) concerning the protection of natural persons with regard to the processing and free movement of personal data.
 
All personal data will be treated equally, whether they are photos, social media posts, IP addresses, bank details, or identification numbers. Any sensitive data will be securely stored and used exclusively with the consent of the individual.
 

  1. Customers will have the right to request the deletion of their personal data in the following cases: The data in question is no longer necessary for the purposes for which it was collected; If the individual withdraws their consent to the processing of their personal data;

13. Competent Court and Online Dispute Resolutions

In the event of judicial disputes with consumers, the competent court pursuant to art. 66-bis of Legislative Decree 206/2005 (Consumer Code) is unconditionally that of the residence (or domicile) of the Consumer.


According to the European Union Regulation no.524/2013, The Consumer has the right to appeal to the European Dispute Resolution Body, as an alternative to the ordinary judicial authorities:
Consumers residing in Europe are informed that the European Commission has established an online platform that provides an alternative dispute resolution tool. This tool can be used by European consumers to resolve non-judicially any dispute related to contracts for the sale of goods and services concluded online and/or arising from them.
